Terms of service
The agreement between you and Bukisha when you use the service.
Last updated: 12 October 2026
This is a draft that is still being reviewed. The final version will be published here before the apps are released.
1. The agreement
Bukisha is run by Bukisha Technologies Africa, based in Kericho, Kenya ("Bukisha", "we", "us"). By creating an account or using the Bukisha apps or website you agree to these terms and to our privacy policy. If you do not agree, please do not use the service.
2. What Bukisha is, and is not
Bukisha is a tool for managing rented property and a marketplace where homes to rent are listed. We are not a landlord, an estate agent or a party to any lease. A tenancy made through Bukisha is an agreement between the landlord and the tenant, and each is responsible for keeping their side of it.
3. Your account
- You must be 18 or older.
- Use your real name as it appears on your identity document, and your own email address and phone number. Temporary or disposable email addresses are not accepted.
- Owners and tenants sign up themselves. A manager joins only by an owner's invitation.
- Keep your password to yourself. You are responsible for what is done through your account; tell us at once if you think somebody else has used it.
- One person, one account. An identity document can verify only one account.
4. Identity checks
Some actions need a verified email, a verified phone number and an ID check. The ID check is a basic automatic check of the photos you provide. It does not consult any government register and cannot guarantee that a document is genuine, so a "Verified" badge is not a guarantee by Bukisha about any person. Deal with other people with ordinary care.
5. Payments
- Bukisha does not handle cash. Rent, deposits, refunds and payments to vendors go through the mobile money, card and bank channels offered in the app.
- A tenant can pay only through the methods their landlord has set up.
- Payments are processed by the payment provider you choose, under that provider's own terms and charges.
- Financial records in Bukisha are permanent. A mistake is corrected by a new entry, not by changing or deleting the old one.
6. Listings and the marketplace
- A landlord or manager who lists a home must have the right to let it, and must describe it truthfully: the photos, rent, deposit, features and availability must be real and current.
- We may remove a listing, or stop an account from listing, where a listing is misleading, unlawful or breaks these terms.
- Some homes on the marketplace may be open only to visitors who hold a marketplace pass. Where a pass is on sale, its price and how long it lasts are shown before you pay. A pass gives access to listings; it does not guarantee that any home is still available or that an application will succeed.
- Before you pay anything for a home, view it and satisfy yourself about it and about the landlord.
7. Landlord subscriptions
- After any free trial, an owner pays a monthly subscription worked out as a percentage of the total monthly rent of the active units in their properties. The current percentage is shown in the app and on our pricing page, and we will tell you before it changes.
- Each month's invoice is made on the 1st and is due by the 7th, Nairobi time.
- If a subscription is not paid on time, the owner's account may be put on hold: listings may be limited or removed and some features paused until it is paid. Records are kept, and tenants can still see their own tenancy records.
- Subscription payments are not refundable except where the law requires or we made an error.
8. What you must not do
- Give false information, or pretend to be somebody else.
- List a property you have no right to let, or take money for a home that is not available.
- Use Bukisha to harass, threaten, discriminate unlawfully against or defraud anybody.
- Upload anything unlawful, or anything you have no right to share.
- Try to get into accounts or information that are not yours, or interfere with how the service runs.
- Copy listings or other people's information out of Bukisha in bulk.
9. Your content
Photos, descriptions, messages and documents you add remain yours. You give us permission to store and show them as needed to run the service, for example to show a listing photo to people searching, or a repair photo to the landlord.
10. Suspending or closing an account
You may stop using Bukisha at any time. We may suspend or close an account that breaks these terms or puts other people at risk. Closing an account does not erase the records that the other side of a tenancy, or the law, needs kept.
11. Our responsibility
We work to keep Bukisha available and accurate, but we provide it as it is, and it may sometimes be interrupted. We are not responsible for what a landlord, tenant, manager or vendor does or fails to do, for the condition of any property, or for the services of payment, network and other providers. Nothing in these terms takes away rights that the law says cannot be taken away. To the extent the law allows, our total liability to you is limited to the amount you paid Bukisha in the twelve months before the claim.
12. Disputes and law
A dispute between a landlord and a tenant is theirs to resolve; the records in Bukisha are there to help both. If you have a complaint about Bukisha itself, contact us first and we will try to settle it. These terms are governed by the laws of Kenya, and the courts of Kenya have authority over any dispute about them.
13. Changes
We may update these terms. The new version will be posted here with a new date, and we will tell you in the app before a significant change takes effect. Using Bukisha after that means you accept it.
